BackEmployment and Labor

The Firm defends employment-related lawsuits from discrimination cases to NLRB matters, from common law wrongful discharge suits to breach of contract claims. The Firm has many years of experience in defending class action cases, including collective actions brought under the Fair Labor Standards Act.

More important than our litigation experience, however, is our goal to work proactively with our clients to avoid litigation. We accomplish this by auditing employment practices, by training managers and supervisors about complying with employment laws while respecting legal rights of employees, and by recommending adjustments to corporate policies or procedures when advisable to ensure full compliance with employment laws.

The Firm focuses on an early analysis of settlement strategies for cases that present significant exposure or those that do not justify substantial legal expense. This focus minimizes our clients’ litigation expenses from the start.

Nelson Mullins differs from most "boutique" labor and employment law firms. We have a diverse group of employment attorneys -- by race, gender, and age. While always seeking to avoid litigation, our employment lawyers practice in a law firm with a 100-year history of litigating cases. As a result, if a case must ultimately be tried, we provide courtroom experience. Many of our associates, not just our partners, have tried cases and appeared before administrative agencies.

Instead of practicing only with other labor and employment lawyers, we operate in a firm that provides advice and counsel in all areas of business law. This enables us to draw upon the knowledge of others with years of experience in an assortment of practice areas -- tax, corporate law, and financial and product liability class actions. Our intellectual property attorneys have experience in one of the fastest-growing areas of employment litigation, intellectual property disputes such as trade secret misappropriation. We have attorneys who are skilled in environmental, tax, immigration, ERISA, and OSHA law as well.

Our experience is not limited to a few industries or states. Nelson Mullins has major clients in industries including financial institutions, securities brokerage, healthcare, telecommunications, computer software, construction, automotive, and other manufacturing, electrical, retail, hospitality, pulp and paper, and transportation. We have handled employment matters for clients in more than 30 states and the District of Columbia.
