Calif. Justices Lift Policy Transfer Barrier In
Landmark Insurance Ruling

Boston partner Greg May’s ABA law journal article was cited and relied upon by the Supreme Court of California in its recent landmark opinion on whether companies can freely assign rights under insurance policies to their successors through corporate restructuring and asset transfers.  The Court’s ruling settles California law on the issue and will likely be viewed as persuasive authority by federal courts and other state courts facing similar questions.  The case is Fluor Corporation v. The Superior Court of Orange County, No. S205889 (Aug. 20, 2015).  Greg’s article is Successors’ Rights to Insurance Coverage for Predecessors’ Preacquisition Activities,  40 Tort Trial & Insurance Practice Law Journal 911 (2005).
