FTC Tool Offers ‘Quick-and-Dirty’ Help

In an article published on April 18, 2016, Nashville partner Roy Wyman provides insight on the new Web-based tool from the Federal Trade Commission that assists health app developers on federal privacy and security rules. Although the tool is designed to help health app developers, app makers and privacy advocates feel that it doesn’t delve much deeper than that. Mr. Wyman says the rules are “helpful to an extent,” but worries that “it can give a sense of false security because the rules are very complex.” A small tweak to a product could have major implications, such as bringing an app that seems to fall outside of HIPAA to one that doesn’t adhere to HIPAA security rules. “There’s a lot of nuance to this.
