The Firm represents many manufacturers of consumer and mechanical products, including household appliance manufacturers, power tool equipment manufacturers, personal care manufacturers, vehicle manufacturers, tire manufacturers, trucks, cranes and other heavy equipment manufacturers. Our attorneys serve as national counsel for one of the largest global manufacturers of home appliances, handling cases all across the United States and Canada in both state and federal courts. From this relationship and others like it, our attorneys have developed experience in every facet of litigation, from early resolution techniques to handling discovery to succeeding at mediation and to trial and beyond. Our attorneys have utilized a process that has been recognized to achieve expeditious and efficient results for our clients across the disciplines. Our goal is, and always will be, client satisfaction.

In the consumer and mechanical product field, our attorneys are seasoned in fire litigation, personal injury litigation and property damage litigation, and recognize that each type requires a unique approach to achieve successful results. We are also experienced in handling design defect, manufacturing defect, failure to warn cases, and are accustomed to the engineering environment required in the successful defense of our clients’ products. The Firm works closely with company engineers in the defense of claims. We also counsel our clients in advance of litigation on engineering changes that may affect litigation so as to minimize legal exposure and risk.

In addition, our attorneys have knowledge and experience in the technology of the truck and automotive products industries that includes transmission litigation, brake litigation, steering system litigation, tire and wheel rim mismatch litigation, ABS cases, allegations of improper handling due to tire rotation patterns and small spare tires, axle failure cases, cruise control, and sudden acceleration cases, as well as a host of less frequently recurring first-collision allegations (e.g., battery boil-over, hood latch releases and jack stability). Our attorneys are schooled in the investigation, accident reconstruction and handling of cases that involve the unique technologies associated with these industries.

The Nelson Mullins Product Practice Group also has handled various matters involving the CPSC and other regulatory bodies, including risk assessment and management, regulatory oversight, product reporting, recalls and litigation.  We are intimately familiar with the Consumer Product Safety Improvement Act of 2008 ("CPSIA"), the Federal Hazardous Substances Act ("FHSA"), the Consumer Product Safety Act ("CPSA"), and the associated rules and regulations implemented by the Consumer Product Safety Commission ("CPSC").  Our attorneys are skilled in evaluating our clients' products – with experience ranging from children's products to furniture to appliances – to ensure compliance with applicable consumer product safety requirements and reducing a manufacturer's exposure to civil and/or criminal fines and penalties.  Our attorneys routinely assess and advise manufacturers regarding product safety crises, product safety reporting issues, government investigations, corrective action plans, and voluntary and involuntary recalls, including the CPSC's Fast Track Product Recall Program.  Our attorneys also work directly with CPSC commissioners and staff to ensure our clients receive the most effective legal counsel possible for their individual regulatory issues.
