The Nelson Mullins Product Liability, Counseling and Reporting Practice Group currently serves as national and regional counsel for numerous companies in various industries across the United States.  We have appeared as lead trial counsel in many of the most feared jurisdictions in the nation and routinely handle dangerous, high exposure personal injury and death cases.  As a result of our deep knowledge and experience in product litigation, five of the nation’s largest companies named Nelson Mullins as their Go-To Law Firm in a 2008 survey conducted by Incisive Media, a leading global provider of specialized business news and informationNelson Mullins was named specifically for its litigation work.

The Nelson Mullins Product Practice Group is a multi-talented, diverse group of attorneys that ranks as one of the largest product defense groups in the nation.  Law 360 ranked Nelson Mullins' product liability practice group in December 2009 as the second largest in the nation with the second largest concentration of product liability lawyers in a law firm.  Law 360 also ranked Nelson Mullins as having the eighth busiest product liability practice in the nation.  The 2009 Litigation Almanac recognized Nelson Mullins as among the top 10 firms in the number and concentration of product liability lawyers and the top 10 firms for the number of times the Firm was hired to represent a litigant. Legal directory publisher Chambers and Partners recently lauded the firm as a national leader in product liability litigation, stating "the litigation department has gained a national reputation in a number of areas, particularly products liability."

Trial Experience

Our experienced lawyers have a long and distinguished record of winning significant victories at trial for a wide range of clients.  According to Legal 500, Nelson Mullins' clients describe its "great trial lawyers" and "creative and certainly cost-effective" with a "a pool of lawyers that permits the staffing up of numerous trial teams simultaneously."  Members of the Nelson Mullins Product Practice Group regularly try cases throughout the country and our trials have been covered by CourtTV, network and cable news, the New York Times, the Wall Street Journal and other various media.  Nelson Mullins litigators have tried cases in nearly all 50 states.   

E-Discovery Experience 

Nelson Mullins has significant experience in helping manufacturers anticipate e-discovery risks before litigation and developing case strategies that minimize costs and risks in preservation, collection, and production of ESI.  Nelson Mullins attorneys presently serve as national discovery counsel for a major tire manufacturer, coordinating all written discovery responses and company witness preparation nationwide.  Our attorneys also currently serve as national electronic discovery counsel for a major pharmaceutical company and work with several others on litigation preparedness projects, including developing search and retrieval procedures, evaluating RFP's for ESI vendors, developing inventories and default positions for data sources, preparing for and defending 30(b)(6) depositions focused on company data sources, and defending collection and production efforts. 

Class Action Litigators 

Lawyers in the Nelson Mullins Product Practice Group have significant experience in handling class action litigation and Nelson Mullins has defended class actions in state courts, federal district courts, bankruptcy courts, and circuit courts of the United States Court of Appeals locally, regionally, and nationwide.  In addition to traditional class actions, we are also experienced in defending claims raised in “opt-out” litigation and have successfully negotiated and implemented settlement programs specifically tailored for mass tort and class action litigation.  In 2009, Legal 500 US ranked Nelson Mullins as the most recommended law firm in the product liability and mass tort defense category for both its pharmaceutical and medical device practice. 

Advocates for Reform of the Justice System 

Nelson Mullins Product Practice Group attorneys also work "off the clock" to serve our clients' interests by actively participating in legislative, judicial, and academic arenas to positively shape statutes, rules, and the common law.  This service often takes place through Nelson Mullins' leadership of organizations such as LCJ, PLAC, DRI, FDCC, and IADC, including: Four past presidents of the Defense Research Institute; Current chair of DRI's Product Liability Committee; Faculty members and/or directors of the International Association of Defense Counsel's Trial Academy; Several former presidents of Lawyers for Civil Justice; and six members of the Products Liability of Advisory Counsel.  Practice group attorneys have also drafted amicus briefs on behalf of PLAC in areas such as expert witness testimony and curtailing the use of junk science in the courtroom.
